    Title: 產科受雇醫師工時調查及納入勞基法後工時設限的衝擊
    The Investigation of Working Hours of Employed Obstetricians and The Impact After Implementation of Working Hour Restriction in Taiwan

    Abstract: 研究目的:台灣醫師納入勞基法議題已爭論多時,衛生福利部預計於109年九月實施,相關醫師勞動權益議題備受關注,過去衛生福利部已擬定住院醫師及所有受雇醫師納入勞基法之具體時程,積極改善醫師之工作條件及落實醫師勞動權益保障。本計畫之研究主旨為蒐集月平均生產數≧20之醫院婦產科受雇醫師之名單,建立調查對象,主要調查婦產科受雇醫師之一週工時狀況,在以醫療品質為基礎之下,制定婦產科受雇醫師合理工時及合理接生量,並進行對目前工作滿意度調查及未來受雇醫師納入勞基法後,其所期待之工作模式,祈能維護受雇醫師之工作權益及生活品質,並提供未來法案修訂之參考。
    研究方法及資料:本計畫原由為針對受雇醫師納入勞基法工時受限之衝擊,其中產科醫師其接生業務具有不可抗拒之緊急因素,工時較長,影響較大,因此排除基層診所執業醫師及醫療業務執行上較不具時效性的婦科醫師,故本次計畫母群體數以醫院以上層級,月平均生產數大於等於20人次之婦產科專科醫師為調查對象。共蒐集96家醫療院所、196位產科受雇醫師。根據台灣婦產醫學會104年參與年會醫師問卷調查,專精於婦科僅16%、產科7%,而大多數醫師為除了執行婦產手術之外亦可接生占77%,故目前並無明顯區分產科或婦科醫師。因此受雇醫師中並無限制產科醫師行為,僅以月平均生產數≧20之婦產科醫師,為產科受雇醫師之代表。本研究經資料蒐集完成之後,經鍵入、譯碼、核對,並去除無效問卷後,以敘述性分析及推理性分析呈現。工時與工作型態則利用Pearson correlation coefficient (r)分析影響工時最大因素。
    研究結果:本問卷調查本次計畫母群體數以醫院以上層級,月平均生產數大於20人次之婦產科專科醫師為調查對象。自106年12月1日到107年1月31日總計回收72份,回收率36.73%其中66份完成周工作日誌。結果顯示,40-59歲之婦產科醫師為現今接生業務之主力(占70%),年輕醫師之受雇醫師則缺乏,醫師性別以男性最多,占60人(83.3%),女性占12人(16.7%)。
    以周工作日誌計算出最長時間為門診,平均為27.33±2.49小時,其次是值班為17.30±4.96小時,再來依序為手術10.02±1.93小時,生產8.14±1.44小時,病歷書寫4.64±0.97小時,4.45±0.99小時,學術研究3.61±2.03小時,其他工作如行政、教學及查房等為3.89±1.38小時。不含待產時間計算,總工時為80.14±6.85小時。如將待產時間計算入工時,其平均為36.79±7.50小時,則總平均工時達116.93±12.41小時。有值班業務之醫師之平均工時為92.08±8.70小時,無值班業務醫師為63.95±7.79小時,對總工時影響有明顯差異,其他工作型態則無明顯差異。接生數目對平均工時無影響,但如果把待產時間納入工時考量,周生產數在10以下,工時為102.47±18.40小時,周生產數在10以上(含10),工時則為131.39±15.40小時,統計上有明顯差異意義。
    合理的一週工時,30.5%的醫師認為應介於50~59小時間,為最多; 29.2%的醫師認為應介於40~49小時間,居第二位;18%的醫師認為應介於60~69小時間。綜合來說,將近六成的醫師所認為的合理工時在每週60小時以下;近八成的醫師認為合理工時在每週80小時以內。合理的接生量調查,52.7%的醫師認為應介於每週5~9個人。
    62.5%的醫師表示在工時設限下,願意將其病人委由值班醫師接生,而願意將病人委由值班醫師接生的45人中,同時有42人(93.3%)也願意接收其他醫師的病人,高達75%的醫師願意在值班期間接收同院其他醫師委託的病患。81.9%的醫師認為在值班接生制度下將可能會增加醫療糾紛。
    結論與建議:依本計畫研究結果顯示接生醫師人力呈現老化及性別失衡現象,且受雇產科醫師之一週平均工作時數高達80.14小時(不含待產時間),也遠高於問卷調查中合理工時。因此在納入勞基法後因應工時設限,產科執業型態勢必會有限制,醫院為考量人力負擔,同時也要探討開放醫院及值班醫師接生制度之可行性,但相對要考慮病人的感受及未來可能增加之醫療糾紛。其中值班業務影響工時最大,此情況在住院醫師工時設限後更明顯,國家對未來受雇醫師合理工時的訂定,所需考量層面甚大,建議主管機關對工時設限應作全面性調查,並依照科別屬性訂立合理工時。
    Objective:Obstetricians have longer working hours and working hour restriction of employed physicians will be implemented thereafter. This study was to determine the weekly working hours of obstetricians and survey the impact of working hour restriction on obstetrics.
    Methods and Materials:Since December 1, 2017, to January 31, 2018, a questionnaire about reasonable workload investigation, impact of working hour restriction and weekly working diary was mailed to 196 employed obstetricians who delivered more than 20 newborns per months in Taiwan. The work types and coefficient of correlation with working hours was evaluated using the Pearson correlation coefficient (r).
    Results:72 returned the questionnaires, 21(31.4%) believed that 40–49 hours were reasonable, while 22(32.8%), 13(19.4%), 7(10.4%), and 4(6%) thought that 50–59, 60–69, 70–79, and >80 hours were reasonable. 66 completed their weekly working diary. The average weekly working hours were 80.14 ± 6.85. If the time of awaiting delivery was calculated into total working hours, then the average working hours were 116.96 ± 12.41. The coefficient of correlation between on-duty and weekly working hours was 0.7. The average work hours of physicians with on-duty work were 92.08 ± 8.7, which were significantly higher than the working hours of those without on-duty works (63.95± 7.79).
    Conclusion and Suggestion:The weekly working hours of employed obstetricians is higher than their expected reasonable working hours. Implementation of working hour restriction will have a significant impact on medical care. It is important to determine a reasonable working hour restriction and modify the patient care model to reduce workload.
